Victims of the Chernobyl disaster
Information of the Department of health of the Gomel regional Executive Committee "About the order of determination of causation of injury or disease resulting in the loss or partial loss of professional working capacity, disability or death, a catastrophe on the Chernobyl NPP, other radiation accidents"
According to article 17 of the Law of the Republic of Belarus from January 6, 2009 "About social protection of citizens affected by the Chernobyl disaster, other radiation accidents" (further – the Law) causation of the injury or disease resulting in the loss or partial loss of professional working capacity, disability or death, a catastrophe on the Chernobyl NPP, other radiation accidents is established to the citizens specified in article 13, paragraphs two and three of article 14, article 15 of the Law, the interdepartmental expert advice on communication diseases, leading to disability or death, at persons, affected by the accident at the Chernobyl NPP, other radiation accidents (hereinafter - MES) and the military-medical commissions.
Reference. In accordance with paragraph 2 of Chapter 1 of the regulations on interdepartmental Advisory councils on establishment of causal relationship of diseases, leading to disability or death, the victims of the catastrophe at the Chernobyl NPP, other radiation accidents approved by the resolution of Council of Ministers of the Republic of Belarus of 11 June 2009, No. 773, interagency councils created for the consideration of issues of causation of injury or disease resulting in the loss or partial loss of professional working capacity, disability or death in individuals affected by the disaster at the Chernobyl NPP, other radiation accidents, with Chernobyl disaster, other radiation accidents.
Expert opinion of MES is the basis for changes in the medico-rehabilitation expert Commission (hereinafter – MEDC) causes of disability of citizens in the phrase "disease associated with the Chernobyl disaster (in other radiation accidents)".
Re-examination of citizens, wholly or partially incapacitated and disability owing to accident on the Chernobyl NPP, other radiation accidents, is the MEDC within 5 years, if these persons do not insist on the earlier date of reexamination.
Re-examination of citizens, wholly or partially, loss of professional work capacity, disability owing to accident on the Chernobyl NPP, other radiation accidents or the age specified статье1 11 of the Law of the Republic of Belarus from April 17, 1998 "About pensions" is only in their written statement or in case an established fact of illegal establishing the cause of the disability or the cause of the disability".
By paragraph 11 of the order of carrying out of medico-social examination (examination of violations of life of patients),
approved by resolution of the Council of Ministers of the Republic of Belarus of 17 December 2014 No. 1185 found that regardless of target direction on mediko-social examination and in the presence of bases, unless otherwise provided by law, in the course of medico-social examination establishes disability, including group, disability, date of onset and duration of disability.
In connection with the above, after carrying out repeated mediko-social examination in MEDC in the following cases:
- changes of the disease that caused the established disability;
- when you make changes and additions to the list of diseases, which may be associated with the catastrophe at the Chernobyl NPP, other radiation accidents approved by the resolution of Ministry of health of the Republic of Belarus of June 26, 2009 No. 73;
- citizens affected by the Chernobyl disaster, other radiation accidents, are sent to the MES or military-medical Commission to determine causation of the disease, leading to disability with the Chernobyl disaster, other radiation accidents, in the procedure established by law.
