Article 328.
Illegal turnover of narcotic drugs, psychotropic substances, their precursors and analogues

1. Illegal without intent to sell manufacture, processing, acquisition, storage, transportation or shipment of narcotic drugs, psychotropic substances or their precursors or analogues

is punished by restriction of liberty for a term up to five years or deprivation of liberty for a term from two to five years.

2. Illegal with intent to manufacture, reprocessing, acquisition, storage, transportation or shipment, or illegal sale of drugs, psychotropic substances or their precursors or analogues

shall be punished by imprisonment for the term from five till eight years with confiscation of property or without confiscation.

Actions envisaged in part 2 of this article committed by a group of persons or an official using their official authority or by a person who has previously committed offences under this article and articles 327, 329 or 331 of this Code, or in relation to narcotic drugs, psychotropic substances, their analogues in the large size, or in respect of especially dangerous narcotic drugs, psychotropic substances or sales of narcotic drugs, psychotropic substances, their precursors or analogues in the territory of educational institutions, healthcare organizations, military units, correctional institution, detention home, in places of detention or place of holding mass events

shall be punishable by deprivation of liberty for a term of eight to thirteen years with confiscation of property or without confiscation.

4. The actions specified by parts two or three of this article committed by an organized group, -
shall be punishable by deprivation of liberty for a term of ten to fifteen years with confiscation of property or without confiscation.

Article 17.3. Drinking of alcoholic, low alcohol beverages or beer, the consumption of narcotic drugs or psychotropic substances, their analogues in a public place or appearance in a public place or at work intoxicated
1. Drinking of alcoholic, low alcohol beverages or beer on the street, stadium, square, Park, public transport or in other public places, except in places intended for the consumption of alcoholic, low alcohol beverages or beer, or the appearance in a public place in a state of intoxication, offending human dignity and morality, or consumption in a public place narcotic drugs or psychotropic substances without appointment of the doctor or consumption in a public place analogues of narcotic drugs or psychotropic substances –
entail imposition of a fine in the amount of up to eight basic units.
2. The presence at the workplace during working hours in a state of alcoholic, narcotic or for abuse of intoxication –
shall entail imposing a fine in amount from one to ten basic units.
3. Actions envisaged in parts 1 and 2 of this article committed repeatedly within one year after imposing of administrative penalty for the same violations, –
entail imposition of a fine in the amount from two to fifteen basic units or administrative arrest.
