ORGANIZATION OF PROCUREMENT
The Ministry of Antimonopoly regulation and trade on the basis of the powers conferred by article 9 of the Law of the Republic of Belarus of 13 July 2012 № 419-Z "On public procurement of goods (works, services)", reports the following.
From 1 July 2019, in accordance with part three of paragraph 2 of article 14 of the Law of the Republic of Belarus "On state procurement of goods (works, services)" (as amended by the Law of the Republic of Belarus of July 17, 2018 No. 136-Z "About modification and additions in the Law of the Republic of Belarus "On state procurement of goods (works, services)", hereinafter the Law in new wording) by the customer (organizer) includes the Commission for public procurement (hereinafter – the Commission) primarily of persons mastered the content agreed with the authorized state body on public procurement educational programs of additional adult education in the field of public procurement, and, if necessary, individuals with specialized knowledge in fields of activity related to the subject of public procurement.
However, this rule applies to both members of the Commission are employees of the customer (organizer) and the non-with the latest in labor relations, but is included in the composition of the Commission.
At the same time the amended Law does not require mandatory that all members of the Commission for public procurement has mastered the contents agreed with the authorized state body on public procurement educational programs of additional adult education in the field of public procurement, and only says pre-emptive inclusion in the composition of the Commission such persons in case of their presence.
At the same time in order to improve the knowledge and skills of those included in the Commission, the Ministry of Antimonopoly regulation and trade recommends that you receive appropriate training in the organisations that agreed on educational programs of additional adult education in the field of public procurement.
